
Why FMCSA Issued the Waiver
Fuel markets are under unusual pressure. AAA's national average for diesel reached $6.3956 per gallon on September 17, 2026, a record in AAA's current series. At the same time, the U.S. Energy Information Administration is warning that distillate inventories—mostly diesel and heating oil—could fall below 100 million barrels in October for the first time since 2003 and remain unusually low into early 2027.
Against that backdrop, FMCSA issued a temporary waiver on September 16 for interstate motor carriers and drivers transporting gasoline and diesel fuel. The waiver runs through December 16, 2026. FMCSA says the purpose is to support timely fuel movement during global supply disruptions, increased late-summer and fall demand, and agricultural harvest needs.
The waiver is important, but it is narrow. It is not a general HOS exemption for dry van, reefer, flatbed, hotshot, box truck or other ordinary freight. A dispatcher or carrier cannot apply it simply because diesel prices are high or because a load is urgent. The relief applies to qualifying transportation of gasoline and diesel fuel under the conditions FMCSA published.
What the HOS Waiver Actually Changes
Under the waiver, an eligible driver may drive up to 16 hours in a 24-hour period. That is more flexible than the normal property-carrier rules, but it is not unlimited driving time. FMCSA also requires a minimum rest period in every 24 hours: at least six consecutive hours in a sleeper berth, or at least eight consecutive hours off duty when no sleeper berth is available.
Drivers must have a valid CDL and all endorsements required for the fuel transportation being performed. Drivers and carriers under out-of-service orders are not eligible, and motor carriers with a conditional safety rating are excluded. Drivers must carry a physical or digital copy of the waiver and present it to law enforcement if requested.
The waiver also contains an important fatigue protection: if a driver tells the motor carrier that immediate rest is needed, the carrier must allow the driver to find a safe resting location and take at least 10 consecutive hours off duty before driving again. When a driver transitions from waiver operations back to normal operations, a 10-hour break is also required if combined waiver and normal operations reach or exceed 14 hours.
Why This Matters to Dispatchers
For a dispatcher working with a qualified fuel carrier, the waiver changes the planning envelope. It can create more flexibility around terminal queues, longer delivery windows, fuel shortages, emergency replenishment and return-to-terminal movements. But it also raises the importance of detailed compliance planning. A dispatcher has to understand not only where the load is going, but whether the driver is eligible for the waiver, whether the vehicle and driver have the necessary credentials, how much time has already been used, and when the required rest must occur.
That means the dispatcher's role becomes less about simply finding a load and more about building a legally workable sequence. A load that looks profitable on paper may be a poor choice if it leaves the driver in a location with no safe parking when a mandatory rest period arrives, or if terminal delays consume the additional flexibility before the delivery is complete.
Can the Waiver Improve Fuel-Load Availability?
Potentially, yes. More flexible HOS can increase the number of delivery opportunities a qualified fuel driver can cover within a day, especially when terminals are congested or deliveries must be made during narrow windows. That can help carriers reposition equipment and serve markets where fuel demand is temporarily stronger than normal.
But dispatchers should not confuse more hours with guaranteed profitability. Tanker work has specialized requirements, hazardous-material rules, terminal access constraints and substantial waiting-time risk. More available drive time only creates value when the rate adequately pays for the miles, wait time, fuel burned, risk and equipment involved.
For dispatchers who do not specialize in fuel hauling, the waiver still matters indirectly. Faster fuel distribution may help reduce localized shortages and can influence diesel availability and price pressure. It is also a reminder that fuel-market disruptions can affect every trucking segment, even when the regulatory relief itself applies only to fuel carriers.
Current Diesel Economics Still Matter
Hours-of-service flexibility does not erase fuel cost. At today's AAA national average of roughly $6.40 per gallon, a truck averaging 6.5 MPG is spending about $0.98 per mile on diesel alone. At 7.0 MPG, the fuel cost is still around $0.91 per mile. Those figures come before truck payments, insurance, tires, maintenance, driver pay, tolls, dispatch fees and overhead.
That means carriers should resist the temptation to chase additional miles simply because the waiver allows them. The right question is whether each added move contributes enough revenue to cover the added fuel and time. A dispatcher can help by comparing the all-in RPM, estimating total fuel burn and considering terminal wait times rather than judging a fuel load by gross revenue alone.
EIA's September outlook suggests the pressure may persist. The agency expects U.S. retail diesel to average about $5.55 per gallon in the fourth quarter of 2026 and says distillate inventories are likely to remain historically tight. Even if pump prices retreat from today's record, fuel remains expensive enough that poor dispatch decisions can erase margin quickly.
How Dispatchers Should Plan Around the Waiver
A disciplined dispatcher should treat the waiver as a compliance rule set, not a shortcut. Before booking or sequencing a qualifying fuel load, the dispatcher should verify the carrier's operating status, driver credentials and endorsements, equipment suitability, current duty status, remaining waiver hours, required rest timing, terminal location and safe parking options.
Terminal delays deserve special attention. A driver may have additional driving flexibility, but hours consumed sitting at a terminal can still affect the overall day and fatigue level. Dispatch should build realistic loading time into the plan rather than assuming every fuel terminal operates on schedule.
Safe-rest planning also matters. The waiver expressly gives drivers the right to stop for immediate rest when needed. A dispatcher should therefore know where legal truck parking, terminals, yards and safe rest locations are along the route. What the Waiver Does Not Change
FMCSA's order does not waive the rest of the Federal Motor Carrier Safety Regulations. Drug and alcohol rules, CDL requirements, insurance requirements, hazardous-material rules, vehicle size and weight limits and other applicable federal and state regulations remain in force. The order also requires crash reporting to FMCSA for crashes involving drivers operating under the waiver.
For dispatchers, that means the safest assumption is that everything not specifically waived still applies. When there is uncertainty, the carrier should confirm the requirement with FMCSA or qualified compliance counsel rather than relying on a dispatcher, load board post or social-media summary.
What General Freight Carriers Can Learn From This
Even carriers that never haul fuel can take a useful lesson from the waiver: operational flexibility has value only when it is paired with disciplined planning. Higher diesel prices make every empty mile more expensive. They increase the value of reliable reload markets, shorter deadhead, better parking, fewer unnecessary detours and cleaner appointment scheduling.

Potential Benefits for Fuel Drivers and Dispatchers
For eligible fuel drivers, the most obvious benefit is greater scheduling flexibility during a period when fuel demand and distribution may be uneven. A driver may be able to complete deliveries that would otherwise be constrained by the normal HOS limits, provided all waiver conditions are met. That can mean fewer missed delivery windows, better utilization of specialized tanker equipment and potentially more revenue-producing work when demand is high.
For dispatchers working with those carriers, the benefit is the ability to build more flexible delivery sequences and respond faster to areas experiencing supply pressure. It may also improve the ability to plan a return trip to the terminal under the waiver, because FMCSA specifies that the relief can continue while the driver returns empty to the carrier's terminal or normal reporting location.
The potential downside is equally important: more available hours can create pressure to over-schedule. Dispatchers should never treat the 16-hour limit as a target that must be reached. Fatigue, terminal delays and safe parking still matter, and FMCSA explicitly preserves the driver's right to request immediate rest.
Bottom Line: More Flexibility, More Responsibility
The temporary HOS waiver is a targeted response to a real fuel-supply problem. Record diesel prices, tight inventories and global disruptions have made efficient fuel distribution a national concern. For qualified fuel carriers, the waiver can create meaningful flexibility through December 16. For dispatchers, it creates an opportunity to improve routing and utilization—but only if compliance and driver safety remain central to the plan.
The broader trucking lesson is straightforward: when fuel becomes more expensive, every operational decision matters more. The strongest dispatch strategy is not the one that simply maximizes miles or hours. It is the one that balances revenue, fuel cost, compliance, driver condition, terminal realities and the next move in the sequence.
